Wilber Rafael Garces Perez, 28, was charged Tuesday in federal court in Austin, Texas, with assaulting, resisting and impeding a federal officer after he was shot by an Immigration and Customs Enforcement officer during a Sept. 20 traffic stop while working as a food delivery driver.
Federal prosecutors allege Garces Perez refused orders to leave his vehicle, drove away and struck an officer with the driver-side mirror. He has disputed the government's account of the encounter, Al Jazeera reported. The charge carries a potential prison sentence of up to 20 years if he is convicted. His attorney said he still has a bullet lodged in his back from the shooting, according to the Guardian.
