A D.C. judge on Thursday permanently dismissed the case against former Olympian David Hearn over allegations that he vandalized the Lincoln Memorial Reflecting Pool, barring the federal government from bringing the same charges again.

Judge Todd Edelman cited “exceptional circumstances,” according to NPR. Fox News reported that the ruling was issued with prejudice, preventing the Justice Department from refiling the case. Hearn had been accused of damaging the Reflecting Pool’s $14 million renovation project in June.

The decision followed U.S. Attorney Jeanine Pirro’s voluntary dismissal of federal charges in late July, Fox News reported. That dismissal drew criticism from President Donald Trump, according to Fox News and NPR.
