Utah Prosecutors Request Judge to Deny Defense Delay in Charlie Kirk Assassination Case

Utah prosecutors are requesting that the judge overseeing the case against Tyler Robinson, accused of attempting to assassinate Charlie Kirk, reject a defense motion to delay a preliminary hearing. This hearing has been postponed for nearly nine months since Robinson's arrest. The defense has appealed the judge's decision to deny a motion to ban news cameras from the proceedings and is seeking a further delay while awaiting a response from the Utah Supreme Court. Prosecutor Christopher Ballard stated in a court filing that the defense has not demonstrated that a stay is necessary to prevent prejudice from media coverage. He noted that much of the evidence has already been made public and that the defense has not shown a realistic likelihood of prejudice if the hearing is open to the public. The preliminary hearing is a critical step in the criminal process, requiring prosecutors to establish probable cause for the arrest. Robinson has not yet entered a plea, and the hearing has been delayed multiple times, most recently from May 16 to July 6. Ballard emphasized that delays negatively impact both the prosecution and the victim's advocate, Erika Kirk, who has requested a speedy trial. Additionally, Robinson's defense filed a separate motion to block hearsay testimony at the hearing, claiming that Utah's laws permitting it are unconstitutional.
