Massachusetts Family's Child Gender Transition Case Involves Court Records

A family from Southborough, Massachusetts, has gained national attention due to claims that their local school and the state are facilitating their child's gender transition. However, court records provide a different perspective. The case highlights ongoing debates surrounding transgender rights. On September 18, 2026, the Trump administration announced an investigation by the Department of Education into the school district involved. Court documents indicate that the child was removed from the parents' custody following allegations of a violent incident. Joseph and Arlene Kutzko, the child's parents, have focused on parental rights in their public statements. They appeared on a Fox News podcast on September 13, pleading for the return of their child, who is currently in the custody of the Department of Children and Families (DCF), and expressed concerns about the state potentially facilitating gender transition medications. Joseph Kutzko stated, "The most important thing is to bring her back to our family. But a shorter term goal is to prevent them from giving her testosterone." The case was reported to the state in early 2025, with both parents facing charges related to an incident at their home in late January of that year. Joseph Kutzko was accused of physically assaulting his child, while Arlene Kutzko was charged with witness intimidation. Court records show that a judge agreed to dismiss charges against Joseph Kutzko if he met certain conditions, including attending anger management classes and adhering to a restraining order. An attorney for the Kutzkos claimed there was no evidence supporting allegations of abuse and suggested that the neglect charge was based on the parents' refusal to support their child's transition. Some court records remain sealed due to the involvement of a minor. A DCF spokesperson stated that lack of support for a gender transition would not justify removing a child from their home. The Kutzkos have not engaged in further interviews and have not had contact with their child since early 2025. They also criticized Algonquin Regional High School for allegedly allowing their child to change their name and pronouns without parental notification, which is permitted under Massachusetts law. Superintendent Gregory Martineau denied any claims of secret counseling. The Department of Education's investigation will assess whether the school district violated any laws regarding parental notification. Governor Maura Healey stated that DCF's involvement was a result of criminal charges against the parents, not related to the child's gender transition.
