NEW YORK (AP) — The Supreme Court this week concluded a significant effort by President Donald Trump to alter the mail voting processes for the upcoming elections, which was deemed unfeasible by election officials due to the short timeline. This case is one of many attempts by the Republican president to exert federal control over the midterms, with several initiatives still in progress as mail ballots have already been distributed in at least three states and early voting begins in others this week.
The Department of Justice has instructed officials in over two dozen states to preserve records from the 2024 election, aiming to obtain detailed voter data despite facing multiple court setbacks. Additionally, the Department of Homeland Security has initiated its own investigation into noncitizen voters on state rolls, a move criticized by a federal whistleblower as rushed and potentially unlawful.
Trump has continued to assert that mail ballots are corrupt and that noncitizens are prevalent on voter lists, claiming widespread Democratic election fraud. Following the Supreme Court ruling, Trump criticized the justices for lacking the courage to protect the country.
The Constitution grants states the authority to conduct elections, and election officials have stated their readiness to ensure a secure election despite Trump's ongoing claims. Democratic organizations are reportedly preparing contingency plans in case of potential interference from armed federal officers at polling places.
Trump's efforts to reform mail voting have been blocked, but he continues to pursue other strategies to influence election procedures. He maintains that noncitizens are voting illegally, despite research indicating this is rare. His administration has sought to enhance the federal voter eligibility database, known as Systematic Alien Verification for Entitlements (SAVE), which was designed to prevent noncitizens from receiving government benefits.
Changes to the SAVE program have been directed by Trump to allow for extensive searches by election officials, although some states have resisted these changes to protect residents' personal information. A federal judge has ruled against the new version of the SAVE program, labeling it an illegal invasion of privacy, and the Supreme Court has yet to respond to the administration's appeal.
The federal government is also pushing states to provide sensitive voter registration information, warning that noncompliance could result in funding losses or investigations. The DOJ has sent letters to 29 states and the District of Columbia regarding the preservation of election documents and ongoing litigation.
Investigations have shown that while noncitizens may occasionally appear on voter rolls, instances of illegal voting are extremely uncommon. In a recent effort to identify noncitizen voters, DHS has directed staff to conduct manual investigations of state voter rolls, which a whistleblower claims involves misrepresentation and could violate state laws.
The initiative, termed the "Unlawful Voter Initiative," raises concerns about the potential wrongful implication of U.S. citizens based on unreliable data. DHS has stated that the investigation is being conducted professionally and involves publicly available data.
Trump's attempts to reshape election administration have faced legal challenges, including executive orders that are currently under litigation. His push for a strict proof-of-citizenship bill, the SAVE America Act, has not garnered enough support in Congress.
Despite these challenges, the Trump administration has utilized law enforcement to take significant actions, such as the FBI's seizure of ballots and election-related documents in various states. Attorney General Todd Blanche indicated that the administration will persist in its efforts to investigate voter fraud.
