Federal Judge Criticizes Trump Administration's Immigration Policies

Rosenfeld/Getty Images</figcaption></figure><p>Judge Patrick Schiltz, chief judge for Minnesota’s Federal District Court, has criticized the Trump administration for what he describes as a “grave threat to the rule of law” during its immigration enforcement actions in Minneapolis earlier this year. </p><p>Schiltz, who was appointed by President George W. Bush, referred to “Operation Metro Surge,” which was part of a mass deportation initiative that resulted in numerous arrests and the deaths of two U.S. citizens by federal immigration agents, according to reports. </p><p>By late January, hundreds of undocumented immigrants had filed habeas corpus petitions challenging their detentions, leading to multiple legal rulings, including orders for the release of many detainees, as reported by The New York Times. </p><p>During a recent interview, Schiltz noted that Immigration and Customs Enforcement (ICE) violated nearly 100 court orders within a month. He stated that these violations disrupted court operations, heightened tensions between protesters and ICE agents, and jeopardized the legal system. </p><p>Schiltz remarked, “I would say aloud to myself, ‘This just never happens.’” He suggested that the violations were primarily due to incompetence rather than intentional defiance of court orders. </p><p>He emphasized that the Department of Justice should have recognized its limitations in managing the situation and taken the issue of noncompliance more seriously. Schiltz stated, “American society rests on the belief that court orders will be obeyed.” He warned that without adherence to the rule of law, society risks descending into anarchy or authoritarianism, drawing comparisons to countries like Russia, China, or North Korea. </p><p>A spokesperson for the Department of Homeland Security responded to Schiltz's comments, asserting that DHS operates in accordance with the U.S. Constitution and federal laws. A DOJ spokesperson indicated that the department would continue to comply with court orders and noted that in many instances of noncompliance, the core substance of the order was fulfilled despite missed deadlines. </p><p>Additionally, DOJ spokesperson Kiersten Pels suggested that federal judges should refrain from giving on-the-record interviews and recuse themselves from commenting on pending matters.
