Retired Judge Discusses Potential Impact of Social Media on Lindsay Clancy's Retrial

<p>If <a href="https://foxnews.com/category/us/lindsay-clancy" rel="noopener noreferrer" target="_blank">Lindsay Clancy's murder trial</a> ends in a mistrial, her defense could hold an unusual advantage in a retrial, according to retired Massachusetts Superior Court Judge Jack Lu, as jurors reported on Wednesday that they remain deadlocked for a second time.</p><p>Clancy, 36, faces three counts of first-degree murder in the deaths of her children — Cora, Dawson, and Callan, all under age 6 — who were found strangled at the family's home in January 2023.</p><p>Judge William Sullivan instructed jurors with a Tuey-Rodriguez charge on Wednesday afternoon after they indicated they were deadlocked, having first signaled difficulty earlier in the week. This charge encourages jurors to continue deliberations while reminding them to consider each other's opinions without compromising their own views.</p><p>Sullivan had opted not to give this instruction earlier in the week when jurors first reported their struggles to reach a consensus.</p><p>The jurors in <a href="https://foxnews.com/us/heated-lindsay-clancy-courtroom-exchange-911-call-crime-scene-photos-sets-stage-moms-murder-trial" rel="noopener noreferrer" target="_blank">Clancy's murder trial</a> are deliberating several options, including first-degree murder, second-degree murder, voluntary or involuntary manslaughter, not guilty by reason of lack of criminal responsibility (insanity), or not guilty.</p><p>Retired Judge Lu stated that traditionally, a retrial after a mistrial has favored the prosecution, but he noted that social media has changed this dynamic. "In the past, the conventional wisdom was that the prosecution is more likely to win on a retrial after a hung jury. Now it's different... The new conventional wisdom is a question mark because of social media's influence on trials," Lu said.</p><p>Lu referenced <a href="https://foxnews.com/karen-read-unleashes-explosive-lawsuit-state-police-canton-police-court-docs" rel="noopener noreferrer" target="_blank">Karen Read's case</a>, which garnered significant social media attention and impacted her trials. In 2024, jurors deadlocked in Read's trial, and she was acquitted at her retrial in 2025.</p><p>Lu remarked, "In the Karen Read case, the social media abuse was at a slow boil in the first trial. At the second trial, it just all erupted."</p><p>Lu mentioned that he has since left social media due to its negative environment.</p><p>While Clancy's attorney, Reddington, indicated he would "absolutely" proceed to trial again if a mistrial is declared, he expressed concern for Clancy's emotional state, stating, "She had a flat affect, she’s sad."</p><p>A GoFundMe for Clancy's parents, the Musgrove family, has raised over $830,000, though it remains unclear who would finance her defense in a retrial.</p><p>Wednesday marked the second occasion the <a href="https://foxnews.com/us/lindsay-clancy-verdict-within-reach-retired-massachusetts-judge-pushes-back-hung-jury-predictions" rel="noopener noreferrer" target="_blank">Clancy jury</a> reported being unable to reach a unanimous decision. In a note sent to Sullivan on Tuesday, jurors stated, "after many hours of deliberation, we are unable to come to a unanimous decision." Sullivan instructed them to continue their work.</p><p>Sullivan addressed the jurors, acknowledging the lengthy trial, which included over 80 witnesses and more than 300 exhibits, and urged them to resume deliberations.</p><p>If jurors report once again that they are deadlocked, Lu indicated that the case would likely <a href="https://foxnews.com/entertainment/harvey-weinstein-rape-trial-ends-mistrial-after-jury-deadlocked" rel="noopener noreferrer" target="_blank">end in a mistrial</a>.</p><p>Jurors are scheduled to return Thursday to continue deliberations, having already spent over 28 hours considering a verdict.</p>
