Federal Judge Rules Against Deportation of Students Criticizing Israel

SAN JOSE, Calif. (AP) — A federal judge in California ruled that the U.S. government is unconstitutionally silencing critics of Israel's actions in Gaza as part of the Trump administration's efforts to deport noncitizens who allegedly disrupted college campuses while expressing their views. Judge Noël Wise issued the ruling on Friday, emphasizing the importance of the First Amendment. The decision supports The Stanford Daily, a student newspaper at Stanford University, which reported that some international students felt threatened by the possibility of deportation for voicing their opinions. "Freedom of speech is illusory if we are only 'free' to express complementary views about the government and its leaders," Judge Wise stated. The ruling builds on a previous decision from a U.S. district judge in Boston, which found that the Trump administration's actions violated the Constitution by targeting noncitizens for deportation based solely on their support for Palestinians and criticism of Israel. Judge Wise noted that the freedoms of speech and the press are foundational to democracy and pointed out flaws in the government's deportation provisions that violate the First and Fifth Amendments. She referenced instances of retaliation by U.S. immigration authorities against individuals who expressed support for Palestinians and criticized Israel. The judge warned that the government's tactics have created a chilling effect on free speech on college campuses, stating, "The government has offered a chilling message regarding protected speech — speak out against Israel or in support of Palestinians and we will revoke your visa and deport you." George Porteous, editor-in-chief of The Stanford Daily, commented on the ruling, stating that reporters should not fear deportation for their work. Conor Fitzpatrick, an attorney with the Foundation for Individual Rights and Expression, which filed the lawsuit, praised the ruling, affirming that free speech should not be limited to views the government agrees with. Judge Wise concluded that noncitizens possess the same First Amendment rights as citizens and criticized the government's vague standards regarding foreign policy and immigration. "Our Constitutional right to freedom of speech guarantees people the right to express — through their words, actions, or assembly — opinions that may be repugnant, views that run counter to prevailing political norms, or beliefs that otherwise challenge the country’s domestic or foreign policy, military engagement, or war," she stated.
