Judge Rules Pentagon's Designation of Anthropic as Supply Chain Risk was Unlawful

A judge has ruled that the US Department of Defense acted unlawfully when it designated artificial intelligence (AI) startup Anthropic as a supply chain risk, describing the action as "illegal and baseless." The ruling came after Anthropic filed a lawsuit claiming that Defense Secretary Pete Hegeth exceeded his authority with the designation, which followed the company's refusal to permit the military to use its AI models for purposes such as surveillance or autonomous weapons. US District Judge Rita Lin stated that citing national security does not provide a justification for punishing and retaliating against government critics. Anthropic welcomed the ruling, with a spokesperson indicating the company's focus on collaborating with the government to utilize AI for national security benefits. Judge Lin noted that the Defense Department unlawfully ordered firms that engage with the US military to boycott Anthropic. In February, the Pentagon designated Anthropic as a supply chain risk, a classification typically reserved for companies based in nations considered threats to the US, marking the first instance of an American company receiving such a designation. Anthropic's lawsuit characterized the government's actions as both "unprecedented and unlawful," asserting that its models were not reliable enough for military weapon systems and opposing their use for domestic surveillance as a violation of rights. The Pentagon contended that private companies should not limit military operations and expressed concerns regarding Anthropic's refusal to accept new contract terms. Anthropic claimed that the government's actions had adversely affected its business and violated its freedom of speech. Judge Lin previously remarked that the government appeared to be attempting to "cripple" the company and "chill public debate" regarding military AI use, describing the situation as a potential case of First Amendment retaliation.
